The requirements of the EU Data Protection Directive have been implemented in different ways in each EU member state. So, for example, in the UK the Directive has been implemented through the Data Protection Act 1998 and in Germany through the Federal Data Protection Act. The law that applies to you will generally be that of the EU country in which you are resident or, if you are a business, in which you are established.
However one common thread is that responsibility for complying with the Directive rests with the data controller. As you are the data controller in respect of personal data you store on Arb Pro, it is your responsibility to ensure compliance with the data protection law of your home country.
In order to make an assessment of whether Arb Pro allows you to meet the requirements of your local data protection laws, we recommend that you carry out a simple risk analysis. As a starting point, The UK Commissioner's Office has produced a useful Code of Practice that provides a helpful list of questions (at page 30) that a data controller should ask in assessing the credentials of any provider of internet-based services.
Answers to the following questions will help you complete a risk analysis for yourself or your organisation. We do so with the firm belief that Arb Pro is well placed to protect the personal data that you entrust to us in accordance with your local data protection law.
Your data is confidential to you. We will not access your data unless requested during a support call to help solve an issue or for the purpose of training. We will ask if you want us to access your data to check or verify any data or processes you need help with.
Our servers and the personal data you store are hosted at secure data centers located in the United Kingdom.
All information which passes between our servers and your computer is encrypted using technology called Secure Sockets Layer (SSL). Go to https://cloud.arbprosoftware.com/Account/Login.aspx and click on the padlock symbol to view our data encryption certificate.
No-one has access to your account unless you invite them. Each user you invite has a username and password for signing in.
It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer by clicking Account > Log out on the top right hand side of the Arb Pro window.
You may also choose to share your account data with other applications. You should apply the same assessment to any application or 3rd party which you grant access to in this way.
We aim to make Arb Pro available 24/7 and you can securely access your data at a time and place convenient to you through a PC, Mac, iPad or iPhone. We also provide the ability to export your contacts to CSV Excel
Background Location services
Both apps CAN track a user’s location in the background whilst the user is out of the office or home location and collecting data.
This is a useful personal safety feature linked to “Lone Working”. Importantly this feature can only be activated or revoked by the app end user, using their permission settings. When a user first sets up the app, Background Location permission is requested, and the end user will decide if this feature is of use and important to their individual safety needs.
What is Loan Working?
A lone worker is an employee or business owner who performs an activity that is carried out in isolation from other workers without close or direct supervision. Such staff may be exposed to risk because there is no-one to assist them in an emergency type situation and so a risk assessment and background tracking may be required.
The app can track a user’s location for the sole purpose of lone working. Tracking can be activated or revoked at any time depending on an individual’s requirements, working location and their own risk assessment and lone working practices.
How is the location data used?
A password protected database includes a single screen showing the location of any company individuals that have elected to allow background tracking from their permission settings.
How is their location displayed?
A single location pin on a map will show the users name and date/time the last known location was captured.
How can the data be considered useful?
The working location is known, and background location tracking is mutually agreed as beneficially useful for both office and individual device user.
